1. Agreement to Terms

These Terms of Service ("Terms") govern your use of DairiQ, the dairy farm management platform operated by DairiQ ("we", "us", "our"). By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use DairiQ.

2. Eligibility

You must be at least 16 years old to create an account. By using DairiQ, you represent that you have the legal capacity to enter into this agreement and that the information you provide is accurate.

3. Your Account

  • You are responsible for maintaining the security of your account credentials.
  • You must provide accurate and complete information when creating your account.
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately of any unauthorised use of your account.
  • Organisation owners can invite members and assign roles. Members act on behalf of the organisation.

4. Acceptable Use

You agree not to:

  • Use DairiQ for any illegal or unauthorised purpose.
  • Upload or transmit viruses, malware, or harmful code.
  • Attempt to access data belonging to other organisations or users.
  • Reverse engineer, decompile, or disassemble any part of the service.
  • Use the service to store data that is not related to dairy farm management.
  • Scrape, crawl, or automated-extract data from the service without permission.
  • Interfere with or disrupt the service or servers.

5. Your Data

You retain ownership of all farm data you enter into DairiQ. You grant us a limited licence to process your data solely to provide and improve the service. You are responsible for the accuracy of data you enter. We are not liable for decisions made based on AI recommendations — the AI assistant provides suggestions, but you remain responsible for all farm management decisions.

6. Subscriptions and Billing

  • DairiQ offers a 14-day free trial with full access. No payment is required during the trial.
  • After the trial, you must select a subscription plan to continue using the service.
  • Plans are billed monthly or annually, payable via M-Pesa or card.
  • Payments are processed at the start of each billing cycle. You can upgrade, downgrade, or cancel at any time from Settings.
  • Upgrades take effect immediately. Downgrades take effect at the next billing cycle.
  • Cancellations stop future billing. Your data is retained for 90 days after cancellation.
  • All fees are non-refundable except where required by law.
  • Prices may change with 30 days' notice. Existing subscribers keep their current rate until the next renewal.

7. Offline Functionality

DairiQ is designed to work offline. Data entered offline is stored on your device and synced when connectivity returns. We are not responsible for data loss caused by device failure, app uninstallation, or other circumstances that prevent syncing of offline data. We recommend syncing regularly to protect your data.

8. Intellectual Property

DairiQ, including its software, design, branding, and content, is our intellectual property. You may not copy, modify, distribute, or create derivative works without our written consent. Your farm data remains your property.

9. Service Availability

We strive for 99.5% uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by maintenance, infrastructure failures, internet connectivity issues, or events beyond our control. We will notify users of scheduled maintenance at least 24 hours in advance when possible.

10. Disclaimers

DairiQ is provided "as is" without warranties of any kind. AI-generated insights are recommendations only and do not constitute veterinary, agricultural, or financial advice. Always consult qualified professionals for animal health, breeding, and business decisions. We are not responsible for losses resulting from actions taken based on AI recommendations.

11. Limitation of Liability

To the maximum extent permitted by law, DairiQ shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or livestock. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Termination

You can cancel your account at any time from Settings. We may suspend or terminate your account if you violate these Terms, if your account is inactive for more than 12 months, or if required by law. Upon termination, your data is deleted after 90 days unless legally required otherwise.

13. Governing Law

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya, unless you are a consumer with mandatory rights in your jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of DairiQ after the effective date constitutes acceptance of the updated Terms.
